MOBILE — U.S. District Judge Ginny Granade struck down Alabama’s same sex marriage ban in a ruling on Friday, according to Yellowhammer News.
The plaintiffs in the case were Cari Searcy and Kimberly McKeand, who were married in San Diego, Calif. in 2008, but have lived in Alabama since 2001. McKeand was the birth parent of a son with a sperm donor and Searcy had sought adoption rights.
According to the article by Cliff Sims, the judge ruled in part, “There has been no evidence presented that these marriage laws have any effect on the choices of couples to have or raise children, whether they are same-sex couples or opposite-sex couples. In sum, the laws in question are an irrational way of promoting biological relationships in Alabama.”
Granade was appointed to the federal bench by President George W. Bush with recommendations from senators Jeff Sessions and Richard Shelby in 2002.
